Slovenian Competition Protection Agency (SCPA), Dunajska cesta 58, 1000 Ljubljana (the Agency), in the context of the procedure for reviewing the concentration of the companies Atlantic Droga Kolinska, Živilska industrija, d. o. o., Kolinska ulica 1, 1000 Ljubljana (ADK), and OSEM podjetje za proizvodnjo, trgovino in storitve, d. o. o., Murska Sobota, Čopova ulica 28, 9000 Murska Sobota (OSEM), based on the first paragraph of Article 75 of the Prevention of Restriction of Competition Act (ZPOmK-2), received a proposal of corrective measures intended to eliminate serious doubts about the compatibility of the ADK/OSEM concentration with competition rules. ZPOmK-2 in the second paragraph of Article 75 stipulates that the Agency shall adopt those remedial measures which it considers can, given the nature, scope, and likelihood of successful and timely implementation, eliminate serious doubts about the compatibility of the concentration with competition rules. The Agency, in order to verify the adequacy of the submitted remedial measures and to ensure transparency and successful consultation with third parties, has decided to conduct a market test of the submitted remedial measures.
All interested participants in the retail meat spread market in the Republic of Slovenia are requested to provide the Agency with:
1. Opinions, proposals, and comments on the draft remedial measure.
2. Suggestions for any other measures which, in their opinion, would be suitable to eliminate doubts about the compatibility of the concentration in question with competition rules.
