The government, state bodies, local community bodies and holders of public authority may not, by general and individual acts or by other actions, restrict the free exchange of goods and services, free entry to the market and free presence on the market, if this prevents free and fair competition.

The protection of the interests of companies in the event of restrictions on the free presence of companies by regulations is primarily ensured in an administrative dispute, but if such protection cannot be ensured, a procedure for assessing the conformity of regulations with the Constitution and laws is envisaged.

In addition to the aforementioned protection of companies, the role of the Agency is also important in ensuring the existence of effective competition. In the context of monitoring and analysing market conditions, it provides opinions to the National Assembly and the Government on general issues within its competence. The Agency also issues opinions in cases where the provisions of a law or other regulation cause a restriction of competition and this is not justified by the general interest, and when free presence on the market is restricted by individual acts and actions.
