PROCEDURE AND METHOD OF DECISION-MAKING IN ADMINISTRATIVE MATTERS

The body responsible for deciding individual matters in administrative proceedings is the panel.
The panel consists of all members of the council, one of whom is the president of the panel.
The panel decides on individual matters within the SCPA's competence in administrative proceedings, in which acts are issued that conclude the procedure before SCPA (orders and decisions). If provided by the ZPOmK-2, the panel also decides on administrative sanctions for companies within these procedures.
The procedure leading up to the issuance of a decision is conducted by a public servant employed at SCPA, authorized by the director to conduct the procedure. This person submits a written report and a draft decision to the panel.
The panel makes decisions after deliberation by voting in a session that is not public. A special record is drawn up on the deliberation and voting, which is filed in a special envelope, and access to this record is allowed only to the competent courts that decide in judicial protection proceedings against acts of SCPA.

PROCEDURE AND METHOD OF DECISION-MAKING IN OFFENSE CASES

In offense proceedings, the director decides on individual matters within SCPA's competence, in which acts are issued that terminate the procedure before SCPA. In the event of the director's exclusion from decision-making in the offense proceedings, SCPA's Council appoints from among the council members or employees at SCPA who meet the conditions for decision-making in offense proceedings a person who will decide in this offense proceeding.  
The procedure until the issuance of a decision is conducted by the director or a public servant employed at SCPA who meets the conditions for conducting the procedure under the law governing offenses and is authorized to do so by the director. The public servant who conducted the procedure submits a written report and draft decision to the director.
